Privacy Policy
Personal data (hereinafter usually referred to simply as "data") is processed by us only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents and the services offered there.
Pursuant to Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as "DSGVO"), "processing" means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
With the following privacy policy, we inform you in particular about the nature, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide on the purposes and means of processing either alone or jointly with others. In addition, we inform you below about the third-party components we use for optimisation purposes and to improve the quality of use, insofar as third parties process data under their own responsibility as a result.

II. Rights of users and data subjects
With regard to the data processing described in more detail below, users and data subjects have the right:
to confirmation as to whether data concerning them is being processed, to information about the data processed, to further information about the data processing and to copies of the data (see also Art. 15 DSGVO);
to rectification or completion of inaccurate or incomplete data (see also Art. 16 DSGVO);
to the immediate erasure of data concerning them (see also Art. 17 DSGVO) or, alternatively, insofar as further processing is necessary pursuant to Art. 17 (3) DSGVO, to the restriction of processing in accordance with Art. 18 DSGVO;
to receive the data concerning them which they have provided and to have this data transmitted to other providers/controllers (see also Art. 20 DSGVO);
to lodge a complaint with the supervisory authority if they believe that data concerning them is being processed by the provider in breach of data protection provisions (see also Art. 77 DSGVO).
In addition, the provider is obliged to inform all recipients to whom it has disclosed data of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17 (1) and 18 DSGVO. However, this obligation does not apply insofar as such communication proves impossible or involves disproportionate effort. Notwithstanding this, the user has a right to information about these recipients.
Users and data subjects also have the right under Art. 21 DSGVO to object to the future processing of data concerning them, provided that the data is processed by the provider in accordance with Art. 6 (1) lit. f) DSGVO. In particular, an objection to data processing for the purpose of direct marketing is permissible.
III. Information on data processing
Your data processed when using our website will be erased or blocked as soon as the purpose of storage no longer applies, no statutory retention obligations prevent the data from being erased and subject to any diverging information we provide below on individual processing procedures.
Shop hosting via Shopify
We use the Shopify shop system to operate our online shop. The provider is Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ("Shopify"). We have concluded a data processing agreement with Shopify.
When you visit our shop or place an order there, your data (e.g. IP address, name, address data, payment information) is processed on Shopify's servers. This may also involve a transfer of data to the parent company Shopify Inc. in Canada and to the USA. The data transfer to Canada is safeguarded by an adequacy decision of the EU Commission. For any transfer to the USA, Shopify uses the standard contractual clauses of the EU Commission.
Shopify is used on the basis of Art. 6 (1) lit. f DSGVO. Our legitimate interest lies in the reliable and secure provision of our online offering. Further information can be found in Shopify's privacy policy: https://www.shopify.de/legal/datenschutz.
Server data
For technical reasons, in particular to ensure a secure and stable website, data is transmitted by your internet browser to Shopify, our shop host. These so-called server log files record, among other things, the type and version of your internet browser, the operating system, the website from which you switched to our website (referrer URL), the page(s) of our website that you visit, the date and time of the respective access and the IP address of the internet connection from which our website is used.
The data collected in this way is stored temporarily, but not together with any other data relating to you.
This storage takes place on the legal basis of Art. 6 (1) lit. f) DSGVO. Our legitimate interest lies in the improvement, stability, functionality and security of our website. The data is erased after seven days at the latest, unless further retention is required for evidentiary purposes.
Cookies
a) Session cookies
We use so-called cookies on our website. Cookies are small text files or other storage technologies that are placed and stored on your device by the internet browser you use. This processing makes our website more user-friendly, effective and secure, as the processing enables us to offer a shopping basket function, for example.
The legal basis for this processing is Art. 6 (1) lit. b) DSGVO, insofar as these cookies process data for the initiation or performance of a contract.
If the processing does not serve to initiate or perform a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 (1) lit. f) DSGVO. These session cookies are deleted when you close your internet browser.

c) Option to remove cookies
You can prevent or restrict the installation of cookies by changing the settings of your internet browser. You can also delete cookies that have already been stored at any time. However, if you prevent or restrict the installation of cookies, this may mean that not all functions of our website can be used to their full extent.
Performance of the contract
The data you transmit in order to make use of our goods and/or services is processed by us for the purpose of performing the contract and is necessary for this purpose. The conclusion and performance of the contract are not possible without the provision of your data.
The legal basis for the processing is Art. 6 (1) lit. b) DSGVO.
We erase the data once the contract has been fully performed, but must observe the retention periods required under tax and commercial law.
Use of payment service providers
To process payments in our online shop, we use external payment service providers (e.g. Shopify Payments, PayPal, Klarna, credit card providers). If you decide on one of the payment methods offered, the data required to process the payment (e.g. name, address, bank details, IP address) is transmitted to the respective service provider.
Your data is transmitted to the payment service provider on the basis of Art. 6 (1) lit. b DSGVO (performance of the contract) and Art. 6 (1) lit. f DSGVO (our legitimate interest in smooth, convenient and secure payment processing). Please refer to the respective privacy policies of the payment service providers for the precise scope of the data processing they carry out.
Disclosure of data to shipping service providers
For the purpose of delivering ordered goods, we work with external shipping service providers (e.g. DHL, Hermes, DPD, GLS). We pass on your name and delivery address to the commissioned shipping company solely for the purpose of delivering the goods. This disclosure takes place on the basis of Art. 6 (1) lit. b DSGVO and only insofar as it is necessary for the delivery of the goods.
Customer account / registration function
If you create a customer account with us via our website, we will collect and store the data you enter during registration (e.g. your name, your address or your e-mail address) exclusively for pre-contractual services, for the performance of the contract or for the purpose of customer care (e.g. to provide you with an overview of your previous orders). At the same time, we store the IP address and the date and time of your registration. This data is not passed on to third parties.
Insofar as you consent to this processing, Art. 6 (1) lit. a) DSGVO is the legal basis for the processing. If the opening of the customer account also serves pre-contractual measures or the performance of the contract, the legal basis for this processing is additionally Art. 6 (1) lit. b) DSGVO. You may withdraw the consent you have given us at any time with effect for the future in accordance with Art. 7 (3) DSGVO.
Contact option
If you contact us by e-mail, the data you provide will be used to process your enquiry. Providing this data is necessary in order to process and respond to your enquiry. The legal basis for this processing is Art. 6 (1) lit. b) DSGVO. Your data will be erased once your enquiry has been conclusively answered and no statutory retention obligations prevent its erasure.
User contributions, comments and reviews
We offer you the opportunity to publish questions, answers, opinions or reviews (hereinafter referred to simply as "contributions") in our online shop as a logged-in user. If you make use of this offer, we process and publish your contribution, the date and time of submission and the pseudonym you use or your name.
The legal basis for this is Art. 6 (1) lit. a) DSGVO. You may withdraw your consent at any time with effect for the future in accordance with Art. 7 (3) DSGVO.
In addition, we also process your IP address and e-mail address. The IP address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution infringes the rights of third parties and/or is otherwise unlawful. In this case, the legal basis is Art. 6 (1) lit. f) DSGVO (legal defence).
Customer reviews (Judge.me): The review widget of the Judge.me service (Judge.me Ltd., City Road 86-90, London EC1V 2NX, United Kingdom) is integrated into our shop in order to display product reviews. When you access a page containing the review widget, Judge.me processes technically necessary data (including IP address and browser data). The reviews displayed originate from a one-off import of our verified eBay buyer ratings. The legal basis is Art. 6 (1) lit. f DSGVO (legitimate interest in presenting customer reviews). An adequacy decision of the EU Commission is in place for the United Kingdom.
Consent management (cookie consent): Our shop uses Shopify's consent management ("cookie consent") in order to obtain, document and manage your consent to the use of non-essential cookies and similar technologies. Your selection is stored in a cookie so that it is taken into account on subsequent visits. The legal bases are § 25 TDDDG and Art. 6 (1) lit. c and f DSGVO (verification and documentation obligations). You may change or withdraw your consent at any time with effect for the future via the cookie settings in the shop.
Social media links: In the footer of our shop, we link to our profiles on Facebook, Instagram, YouTube, TikTok and X. These are simple links without embedded content from the providers; merely visiting our shop does not transfer any data to these providers. Only when you click on a link do you leave our shop; from that point on, the data protection provisions of the respective provider apply.
Google Analytics 4, Google Tag Manager and Google Ads: We use Google Tag Manager, via which the Google Analytics 4 and Google Ads services are integrated. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses cookies and comparable technologies to analyse the use of our shop statistically – for example pages accessed, time spent and the origin of visits; the IP address is truncated in the process. Google Ads serves to measure the success of our advertisements (conversion tracking). The legal basis is your consent pursuant to Art. 6 (1) lit. a DSGVO in conjunction with § 25 (1) TDDDG, which you give via our cookie banner. Without your consent, these services are not executed. You may withdraw your consent at any time with effect for the future via the cookie settings in the shop. In this context, personal data may also be transferred to Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework, and the standard contractual clauses of the EU Commission apply in addition. The storage period depends on the retention period configured in Google Analytics. Further information can be found in Google's privacy policy.
Google Kundenrezensionen: We participate in the "Google Kundenrezensionen" (Google Customer Reviews) programme operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. After completing an order, you will be asked on the order confirmation page whether Google may send you a short survey about your purchase. Only if you consent there do we transmit your e-mail address and details of your order – in particular the order number, the items ordered, the country of delivery and the expected delivery date – to Google. Google thereby receives information about transactions you carry out in our shop. Google will then send you a questionnaire; the ratings submitted may be aggregated and displayed publicly in connection with our shop. The legal basis is your consent pursuant to Art. 6 (1) lit. a DSGVO. You may withdraw it at any time with effect for the future by notifying us at info@bikely.one; the lawfulness of the processing carried out up to that point remains unaffected.
Within the scope of Google Kundenrezensionen, Google and other third parties may store and read cookies on your device or use comparable technologies such as tracking pixels in order to collect information about this programme. Access to your device only takes place after you have given your consent in accordance with § 25 (1) TDDDG. You can refuse cookies via your browser settings, delete cookies that have already been stored and disable the storage of cookies in general; in this case, it is possible that not all functions of our shop will be usable without restriction. You may also change your selection at any time via the cookie settings in the shop.
