General Terms and Conditions (GTC)

§ 1 Scope and provider

These General Terms and Conditions apply to all orders that you place with the Sam Berens online shop, trading under the business name “bikely” (hereinafter “Provider” or “Bikely”).

§ 2 Conclusion of contract

(1) The product representations in the online shop do not represent a binding offer, but rather an invitation to order.

(2) By clicking the order button at the end of the ordering process, you are making a binding offer to conclude a purchase contract for the goods contained in your shopping cart.

(3) The automatic confirmation email immediately after sending your order only documents receipt and does not constitute acceptance. The purchase contract is concluded as soon as we expressly declare acceptance or ship the goods and inform you of this by email (shipping confirmation).

§ 3 Prices and payment conditions

(1) The prices stated on the product pages include statutory VAT and other price components. In addition, there are any shipping costs according to our shipping page.

(2) Payment can be made either via PayPal or Shopify Payments (including credit card, Klarna, Apple Pay, Google Pay).

(3) If you select the payment method PayPal or Shopify Payments, your account will be debited when the order is completed.

§ 4 Shipping and delivery

(1) Shipping takes place from our logistics warehouse in 48734 Reken.

(2) Delivery takes place within Germany (3-5 working days) as well as to all other member states of the European Union and to Switzerland and the United Kingdom (3-8 working days each). The complete list of countries and the respective shipping costs can be found on our “Shipping” page.

(3) If transport damage is discovered to the goods, we ask you to complain to the delivery company (DHL) immediately if possible and to contact us. Failure to make a complaint has no consequences for your statutory warranty rights, but helps us to assert our claims against the carrier.

§ 5 Retention of title

The goods remain the property of Sam Berens until full payment has been made.

§ 6 Warranty and liability

(1) The statutory liability law for defects applies.

(2) Note on installation: The spare parts offered are intended for professional installation. There is no defect if damage is due to improper installation, incorrect assembly or improper commissioning after the transfer of risk; Your statutory warranty rights remain unaffected.

(3) We are liable without limitation for damages resulting from injury to life, body or health as well as in cases of intent and gross negligence, as well as in accordance with the Product Liability Act. In the case of simple negligence, we are only liable for the violation of essential contractual obligations (cardinal obligations), limited to the foreseeable damage that is typical for the contract; Otherwise liability is excluded.

§ 7 Contract text storage, input errors and codes of conduct

(1) We save the contract text (order data and general terms and conditions) and send you the order data and these general terms and conditions by email. You can view and print out the terms and conditions on this page at any time. You can also view your past orders in your customer account, if you have created one.

(2) Before the order is bindingly sent, all order data will be displayed to you in an overview. You can recognize input errors there and correct them at any time using the correction function in your browser as well as using the editing and deletion functions in the shopping cart and during the ordering process. You can cancel the ordering process at any time until you click the order button.

(3) The contract is concluded in German.

(4) We have not subjected ourselves to any special codes of conduct.

§ 8 Contract language and final provisions

(1) The contract language is German. If the contents of the shop are displayed in other languages, these are non-binding translations for informational purposes; The German version is decisive.

(2) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice of law only applies to consumers to the extent that it does not revoke the mandatory consumer protection regulations of the country in which you have your habitual residence.
